Florida Law Changes Made it Easier for Landlords to Evict; but Tenants Have Rights, too

evictionFor many people, renting a home is the best option for them due to their lack of good credit and other factors. The people who own these rentals can also have a hard time due to getting the wrong tenants into their homes. The state of Florida has now passed a few new laws that help with the rights of the landlords as well as the tenants. The following are a few of the laws that will prove to be helpful for both parties.

For the Tenant

One of the best provisions that the state has set forward in these new laws is in regards to the security deposit. The law states that if the landlord is wanting to keep the security deposit, but does not give the tenant a 30 day notice, then they have to refund the whole amount of the deposit. This will allow the tenant that is being evicted ample time to get their affairs in order before they are kicked out of the home. You need to make sure that the landlord you have stays in compliance with these laws.

For The Landlord

Another law that was set forth by the state that helps the landlord states that if the tenant is not in compliance with the rental agreement, they have 7 days to do so or they will be evicted. This will help the landlord to streamline the eviction process and get a bad tenant out in no more than a week. You need to make sure that the rental agreement that you have with a tenant clearly lays out what is expected of them.
